SPLM for Democratic Change or SPLM-DC leader says President Salva Kiir’s order creating 28 states clearly violates South Sudan Transitional Constitution, 2011 and Compromise Peace Agreement signed in August 17 and 26.
Dr Lam Akol Ajawin debates in a public lecture at the University of Juba that President Kiir has exceeded the powers accorded by the constitution to interfere with the jurisdiction of the Council of States in changing state boundaries and names, Radio Bakhita reported.
Presidential Legal Affairs Advisor Lawrence Korbandy insists that the constitution has not been broken, saying government shall amend Constitutional Article 162 which specifies South Sudan states as ten and authorizes Council of States to resolve state boundary alteration by two-thirds before the order becomes effective.
Advisor Korbandy says President Kiir’s creation is likely to proceed if the cabinet approves the order.
Community Empowerment for Progress Organization or CEPO Executive Director Edmund Yakani says South Sudan political players should prioritize the implementation of the peace agreement they signed before creating more states on ethnic consideration.
