East African Court of Justice First Instance Division dismissed a case against the Attorneys General of five member states including Uganda, Kenya, Tanzania, Rwanda and Burundi to bar South Sudan from joining the East African Community or EAC.
In a statement, the Court ruled out Uganda Traders Association of South Sudan Ltd case to stop South Sudan membership application to East African Community.
The Court requires a case made by a corporate body accompanied by documentary evidence of its existence in law.
Uganda Traders’ Association leaders Patrick Ntege Walusimbi, Dan Ssenga and Mohammed Waiga filed the case in September 2014 against South Sudan interest in joining the East African Community.
They argue that South Sudan does not adhere to universally accepted principles of good governance, democracy, rule of law, observance of human rights and social justice as required under Article 3 (3) b of the EAC Treaty.
