HIGH COURT ADJOURNS RULING ON SECURITY CHIEF DETENTION

The High Court has adjourned a ruling on whether the director of public security’s arrest and detention at an army barrack for 14 days was legal.

Advocate Kiir Chol, who represents Major General Marial Nuor Jok, said he was denied access to his client.

He explained that today’s sitting was for the High Court to answer his application to the Justice Ministry that the arrest of Mr. Nuor was illegal and he should be brought to the court.

The Constitution of South Sudan says the Police has to present to a judge any person detained for more than 24 hours.

The lawyer said his defence team insists that Mr. Nuor’s arrest is against the Constitution.

Mr. Chol added that the ruling was postponed till Monday because the judge wanted to study the case.

He said his team is urging the judge to rule quickly because the defendant is been detained in a military prison illegally.

He explained that the 2009 Police Service Act says that any accused police personnel should be kept in police custody, not by the military.

Mr. Chol dismissed the charges filed against his client as mere allegations.
